What is subrogation in insurance?

Subrogation is the process by which your insurance company, after paying your claim, pursues the party responsible for causing the loss to recover what it paid. Your carrier essentially steps into your shoes to go after the at-fault party.
How it works: a concrete example
A driver runs a red light and hits your car. You file a collision claim with your own carrier. Your carrier pays you $12,000 for your car's damage. Your carrier then sues or negotiates with the at-fault driver's insurance company to recover the $12,000. When they recover it, you typically also get your deductible back.
Why subrogation matters to you
Deductible recovery
When your carrier successfully subrogate against the at-fault party, you may recover your deductible. If your deductible was $1,000 and your carrier recovers the full claim amount, you get the $1,000 back.
Cooperation requirement
Your policy requires you to cooperate with subrogation. Do not sign a release of claims against the at-fault party without your carrier's knowledge, doing so can waive their subrogation rights and you may owe your carrier back what they paid.
Waiver of subrogation
In business and lease contexts, you may be asked to add a waiver of subrogation to your policy, agreeing not to pursue a named party (typically the building owner or general contractor) for a covered loss. This is a policy endorsement, not something you can grant verbally.
Home insurance subrogation example
Your neighbor's tree falls on your home during a storm. You file a home insurance claim. Your carrier pays the claim. If your carrier believes your neighbor was negligent, they had prior notice the tree was dead or diseased, they may subrogate against your neighbor's homeowner's liability coverage to recover what they paid.
Auto subrogation
Most common in car accidents. If the other driver is at fault and their insurer is uncooperative, your carrier pursues subrogation on your behalf. You don't have to manage this process, your carrier does. Your job is to cooperate and not sign anything that waives your rights without clearing it with your carrier first.
