After an accident, even a perfectly repaired vehicle is worth less than one with a clean history. The difference in market value is called "diminished value," and in NC, you may be entitled to recover it from the at-fault driver's insurance company.
Three types of diminished value
- ·Inherent diminished value: the most recoverable type. The loss in market value that occurs simply because the vehicle has an accident history, regardless of repair quality. A car with an accident on its Carfax report sells for less, period.
- ·Repair-related diminished value: additional value loss from substandard repairs, parts that don't fit perfectly, mismatched paint, or structural issues.
- ·Immediate diminished value: the difference in value immediately after the accident, before repairs are completed.
When you can file a DV claim in NC
NC is a third-party DV state. Key conditions:
- ·Your vehicle was damaged by an at-fault driver
- ·The accident was not your fault
- ·NC is a contributory negligence state, even 1% fault may affect your ability to recover
- ·You claim from the other driver's carrier, not your own
- ·Statute of limitations: 3 years from the date of the accident
How DV is calculated
The 17c formula is a common methodology used by many insurers, but it often undervalues DV claims. You can dispute an insurer's calculation with your own appraisal from an independent appraiser. Luxury and high-value vehicles typically have higher DV, they lose more in resale value from an accident history.
