What is EPLI?

Employment practices liability insurance (EPLI) covers your business against claims from employees alleging wrongful employment practices. It is one of the most common but underutilized business insurance policies for small and mid-size NC employers.

NC employment law context

NC is an at-will employment state, employers can generally terminate at will. But at-will employment does not protect against discrimination or harassment claims. The NC Equal Employment Practices Act and federal law still apply to NC employers regardless of employee count. A wrongful termination claim can proceed even when the termination itself was lawful.

Does a small NC business with 5 employees need EPLI?

Yes. There is no minimum employee count for EPLI. Federal employment discrimination laws (Title VII) apply to businesses with 15 or more employees, but state laws and common law claims can apply to smaller employers. Defense costs alone justify EPLI for any employer.

Does EPLI cover wage and hour claims in NC?

It depends on the policy. Many EPLI policies exclude wage and hour violations (overtime, minimum wage, misclassification claims). Some endorse it back in, verify before assuming coverage.

What is the difference between EPLI and workers' comp?
