What liability insurance covers

Liability insurance pays for damages you're legally responsible for causing to other people or their property. It does not pay for your own injuries or your own property. The core purpose: if something goes wrong and you're at fault, liability coverage keeps you from paying out of pocket.

Where liability coverage appears

Auto insurance

If you cause an accident that injures someone or damages their car, your liability coverage pays their medical bills and repair costs. NC requires minimum liability coverage (50/100/50 by law, but these minimums are dangerously low).

Home insurance

If someone is injured at your home (a guest slips on your stairs, your dog bites a neighbor), or if you accidentally damage someone else's property, your home policy's liability coverage responds.

Renters insurance

Same as home insurance liability, covers injuries to others that occur in your rental unit.

Umbrella insurance

Excess liability on top of your auto and home policies. Adds $1M or more of additional protection when underlying limits aren't enough.

Business insurance

Commercial general liability (CGL) covers bodily injury and property damage claims arising from your business operations.

NC auto liability minimums and why they're not enough

NC requires 50/100/50, $50,000 per person, $100,000 per accident for bodily injury, $50,000 for property damage. These minimums are outdated. A single serious injury claim can easily exceed $30,000.

  • Recommended minimum: 100/300/100
  • Better: 250/500/100 with a personal umbrella policy
  • The cost difference between 30/60 and 100/300 is often less than $100/year

Home liability limits

Most home policies default to $100,000 of liability coverage. A better target is $300,000 to $500,000. If you have a pool, a trampoline, a dog, or significant personal assets, add a personal umbrella policy for $1M or more of additional liability protection. Umbrella policies are inexpensive relative to the coverage they provide.

What liability insurance does not cover

  • Your own injuries (covered by health insurance or medical payments coverage)
  • Intentional acts
  • Damage to your own property
  • Business-related claims on a personal policy

Cooper's take

NC's minimum auto liability limits are embarrassingly low. Serious accidents create claims that dwarf the minimums. For less than $100/year in additional premium, you can increase from 30/60 to 100/300. Do it. And if you have meaningful assets to protect, add an umbrella, it is the most underused, underpriced coverage in personal insurance.

Frequently asked questions

What are the minimum liability limits required in NC?

NC requires 50/100/50 auto liability. This means $50,000 per person, $100,000 per accident for bodily injury, and $50,000 for property damage. These are legal minimums, not recommended coverage levels.

Does liability insurance cover me if I'm in an accident?

It covers the other party's damages when you're at fault, not your own. Your own vehicle damage is covered by collision; your own injuries by your health insurance or the other driver's liability.

How much liability insurance do I need on my home?

Most policies default to $100,000. A better target is $300,000-$500,000. If you have significant assets, add a personal umbrella policy for $1M-$2M of additional coverage.

What is umbrella insurance in relation to liability?

An umbrella policy sits on top of your auto and home liability coverage. When a liability claim exceeds your underlying policy limits, the umbrella pays the difference up to its limit.
